Wills for married couples made before October 2007 normally included a discretionary trust to allow the surviving spouse to benefit from the deceased spouse's estate while utilising the inheritance tax allowance called the nil rate band. Legislation introduced since that date allows for this allowance to be transferred between spouses and civil partners so those trusts may no longer be required.
It is thus important to check the date and contents of your Will and update it if necessary.
